These Terms are written to make the ordering relationship clear. Please review them before using the Site or completing a purchase. If you have a question about a product’s suitability, installation, delivery, or return eligibility, contact Your Serenity before placing your order.
These Terms & Conditions (“Terms”) form a binding agreement between you and Your Serenity, Inc. (“Your Serenity,” “we,” “us,” or “our”). They govern your access to yourserenityinc.com (the “Site”), your use of its features, and all orders placed through the Site.
By accessing the Site, creating an account, or placing an order, you agree to these Terms and the policies incorporated into them, including our Privacy Policy and Refund & Returns Policy. If you do not agree, do not use the Site or place an order.
Product-specific terms clearly disclosed before purchase form part of these Terms. Mandatory consumer rights control if they conflict with any provision below.
You must be at least 18 years old, or the age of legal majority where you live, and legally capable of entering a binding agreement to place an order. If you use the Site for an organization, you represent that you are authorized to bind that organization.
You agree to provide accurate, current, and complete account, billing, shipping, and contact information. You are responsible for safeguarding your login credentials and activity conducted through your account. Notify us promptly if you suspect unauthorized use.
We make reasonable efforts to present product descriptions, photographs, specifications, compatibility information, and availability accurately. Screen settings, product revisions, packaging changes, and photography may cause minor differences in appearance.
Products and quantities are subject to availability. We may limit quantities, discontinue products, revise specifications, or correct errors before accepting an order. If a product feature is essential to your purchase, contact us before ordering.
Your order is an offer to purchase the products listed in the order. An automated confirmation acknowledges that we received it; it does not necessarily mean that we accepted it.
We may accept an order when we send a shipment confirmation or otherwise expressly confirm acceptance. We may reject or cancel an order because of unavailable inventory, quantity limits, suspected fraud, payment problems, inaccurate information, pricing or description errors, legal restrictions, or an inability to fulfill the order.
If we cancel an order after collecting payment, we will issue the legally required refund. Requested changes or cancellations are not guaranteed after processing begins.
Prices are displayed in U.S. dollars unless the Site states otherwise. Applicable taxes, shipping charges, duties, and other disclosed costs are calculated or presented before checkout is completed.
We may correct an obvious pricing or product-description error before accepting an order. Payment is processed through the options shown at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges.
If you believe a charge is incorrect, contact us promptly so we can investigate.
Processing and delivery dates are estimates unless we expressly state otherwise. You are responsible for providing a complete, accurate, and deliverable address. Additional costs caused by an incorrect address, refused delivery, or failure to collect a shipment may be charged or deducted from an available refund to the extent permitted by law.
If we cannot ship within the stated time—or within the period required when no time is stated—we will provide any delay, cancellation, consent, or refund options required by applicable law. Canadian and other cross-border customers are responsible for duties, taxes, brokerage charges, and customs requirements unless we expressly agree otherwise.
Contact us promptly about a lost, damaged, or incorrectly delivered shipment, and retain the product and packaging while the matter is reviewed.
Eligible products may be returned within 30 calendar days of delivery, subject to prior authorization and the eligibility, packaging, proof-of-purchase, and shipping requirements in our Refund & Returns Policy.
The EMF MemonizerMobile is excluded from the 30-day return policy and is considered a final-sale item, except where a return, replacement, warranty remedy, or refund is required by law.
A 15% restocking fee applies to all approved returned items. It is calculated from the purchase price of each returned item, excluding sales tax and original shipping charges, and deducted from the approved refund. The fee does not apply where prohibited by law or where mandatory consumer rights require another remedy.
All Memon transformers are removable and transferable if you move or replace the residence, office, vehicle, equipment, or other item for which the transformer was originally selected. Any removal, reinstallation, inspection, or professional-service costs are the customer’s responsibility unless expressly agreed otherwise in writing.
Repeatedly rotating a device on a short-term basis between a residence, office, car, or other location is counterproductive and is not recommended. Follow the manufacturer’s placement, installation, and use instructions for the particular product and intended location.
Memon devices have not been evaluated by the U.S. Food and Drug Administration (FDA). Your Serenity does not represent that these products diagnose, treat, cure, or prevent any disease or medical condition. No health-related or medical claim should be inferred from these Terms, an order, or general product information.
Information on the Site is provided for general informational purposes and is not medical advice or a substitute for professional diagnosis or treatment. Consult a qualified healthcare professional regarding health concerns. Do not disregard or delay professional care because of information found on the Site.
Experiences vary, and we do not guarantee a particular physical, health, wellness, environmental, or performance outcome.
You are responsible for selecting a product suitable for your intended application and following all manufacturer instructions, warnings, maintenance guidance, and compatibility requirements. Use a qualified electrician, installer, technician, or other professional whenever instructions or applicable law require one.
Do not alter, misuse, improperly install, or operate a product outside its documented purpose. To the extent permitted by law, we are not responsible for damage caused by misuse, unauthorized modification, unsuitable conditions, failure to follow instructions, or improper installation or removal.
Some products may include a manufacturer’s limited warranty. Any such warranty is governed by its own written terms, eligibility requirements, exclusions, claim procedure, and remedy. Keep your order confirmation and supporting documentation.
Unless Your Serenity expressly provides a separate written warranty, we do not enlarge, replace, or extend a manufacturer’s warranty. Nothing in this section limits warranties or remedies that cannot legally be excluded.
The Site and its text, graphics, logos, photographs, videos, layout, software, and other content are owned by or licensed to Your Serenity and are protected by intellectual-property laws. Product names and trademarks belong to their respective owners.
You may use the Site for personal, lawful shopping and informational purposes. You may not copy, republish, sell, modify, distribute, frame, scrape, or commercially exploit Site content without prior written permission or another lawful basis.
The Site may use or link to independent payment processors, shipping carriers, media providers, analytics services, security services, social platforms, and other third parties. Their own terms and privacy notices govern their services.
We do not control independent third-party websites or services and are not responsible for their content, availability, security, or practices. A link or integration does not necessarily imply endorsement.
You may not:
We may restrict access, cancel affected orders, preserve relevant records, or take other lawful action when we reasonably believe these Terms have been violated.
To the fullest extent permitted by law, the Site and its general informational content are provided “as is” and “as available.” We do not guarantee that the Site will always be uninterrupted, error-free, secure, or free of harmful components, or that every description or image will be completely free of minor errors.
Products remain subject to any applicable express written warranty and mandatory consumer protections. We do not exclude any warranty, condition, right, or remedy that applicable law does not allow us to exclude.
To the fullest extent permitted by law, Your Serenity and its owners, officers, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from the Site, an order, or a product. Where liability may lawfully be limited, our aggregate liability relating to a product or order will not exceed the amount you paid us for the product or order giving rise to the claim.
These limitations do not apply to fraud, willful misconduct, personal injury caused by negligence where liability cannot be limited, or any other liability or consumer remedy that applicable law prohibits us from excluding or limiting.
These Terms are governed by the laws of the State of New York and applicable federal law, without regard to conflict-of-law principles. Before filing a formal claim, please contact us and provide a reasonable opportunity to address the matter.
To the extent permitted by law, disputes may be brought in the state or federal courts serving Westchester County, New York. This provision does not remove any non-waivable right a consumer may have to bring a claim in another jurisdiction or under the law of the consumer’s place of residence.
We may revise these Terms to reflect changes in our business, products, Site, or legal obligations. The revised version will display a new “Last updated” date. Changes apply prospectively from publication unless applicable law requires otherwise. The Terms presented when an order is placed will generally govern that order.
If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of it.
These Terms, the policies incorporated by reference, and product-specific terms disclosed before purchase form the agreement between you and Your Serenity concerning the Site and your order, except for a separate written agreement signed by an authorized representative.
